The proposed law would exempt from the state gasoline sales tax any sale of fuel for automotive use, including a sale of unleaded gasoline and diesel fuel, if the sale occurs at a time when the retail price for regular gasoline in Massachusetts is greater than or equal to $2.00 per gallon. The availability of this tax exemption would be subject to legislative appropriation.

The proposed law would take effect starting in tax year 2025.

The text of the proposed law

Be it enacted by the People, and by their authority:

SECTION 1. Definitions –

“Benchmark price per gallon in Massachusetts”, the weekly retail gasoline price per gallon for regular gasoline in Massachusetts, including taxes, as calculated by the US Energy Information Administration.

“Published benchmark price per gallon in Massachusetts”, the most recent benchmark price per gallon in Massachusetts that has been made public by the US Energy Information Administration.

SECTION 2.

The sale of fuel for automotive use, including but not limited to unleaded gasoline and diesel fuel shall, subject to appropriation, be exempt from the tax per gallon contained in Chapter 64A of the General Laws if the sale occurs at a time that the published benchmark price per gallon in Massachusetts is greater than or equal to two dollars.

SECTION 3.

The provisions of this act shall take effect on January 1, 2025
